Intellectual property and copying
What to do if something on Luma uses your work, brand or design without permission, and what makers need permission for before they list.
Last updated
Everything on Luma is meant to be the maker鈥檚 own. If you find your photos, artwork, designs or brand used here without your permission, tell us and a person will look at it.
Where to report it
| Where it is | How to report it |
|---|---|
| A listing | Report this listing, then choose Intellectual Property / Copying Concern |
| A shop page, such as its name, logo or banner | Report this shop, then choose Uses my work, brand or design without permission |
| Anywhere else, or you don鈥檛 have an account | Our contact form: choose Report illegal or harmful content, then Uses my work, brand or design without permission |
The first two need you to be signed in. The contact form doesn鈥檛, so you can use it whether or not you shop or sell on Luma.
What to include
We can only act on what we can check. A report we can act on straight away tells us:
- Who you are, and whether you own the rights or act for someone who does.
- What the original is. A link to it, or a photo. For a registered trade mark or design, the registration number.
- Where it is on Luma. A link to each listing or page. If one shop has several, send them all.
- Why it鈥檚 yours. For example, the photo was taken by you, the design is copied from your pattern, or the name or logo is your trade mark.
- How to reach you, in case we need more.
Please also confirm that what you鈥檝e sent is accurate as far as you know, and that you own the rights or have permission to act for whoever does.
What happens next
A person at Luma reads every report. Where it鈥檚 clear that something infringes, we take it down. That鈥檚 usually the listing, and it can be the whole shop if it keeps happening. When we take something down, we tell the maker what came down and why.
Where it isn鈥檛 clear from what we have, we鈥檒l ask you or the maker for more before we decide. We can鈥檛 settle who designed something first when two people both say they did, and we can鈥檛 rule on the wording of a licence. Those stay between you and the maker, or for a court.
We鈥檒l confirm your report reached us. As with any report, we won鈥檛 tell you what happened to the maker鈥檚 account, but you can check the listing yourself.
If you鈥檙e a maker
Only list what鈥檚 yours to sell. Before you publish, check you have the right to use:
- the photos, which should be your own or used with the photographer鈥檚 permission
- the design, if it comes from a pattern, a template or someone else鈥檚 artwork
- any character, logo or brand name on the item or in its title
- the words in your listing and shop
The usual trip-ups:
- A sewing, knitting or crochet pattern whose licence doesn鈥檛 cover selling what you make from it. The designer鈥檚 terms will say.
- Fabric, stickers or charms showing a brand鈥檚 characters or logo. Using them in something you sell can still infringe.
- A photo or description taken from another shop or a supplier鈥檚 website.
- A shop name that sits close to an existing brand.
We can鈥檛 give legal advice about your own work. If you鈥檙e not sure, ask the rights holder, or a solicitor.
If something of yours is taken down and you do have permission, or you think we got it wrong, use our contact form and choose Complain about a decision. Send whatever shows it, such as a licence or an email from the rights holder. We鈥檒l look again, and if we were wrong we鈥檒l put it right.
Using someone else鈥檚 work more than once can lead to your shop being suspended or closed, as our terms set out.
Reporting in good faith
Only report something you believe infringes your rights, or the rights of someone you act for. A report made to take down a competitor is a misuse of reporting under our terms, and we can see patterns in who reports what.
